Service Terms & Conditions
Delivery Timeline
We strive to deliver all media within twenty-four hours of the scheduled appointment. However, appointments scheduled on Fridays or over the weekend may not be delivered until Monday.
Aerial Photography Services
Aerial photography and video services may be delayed or cancelled due to conditions beyond our control such as weather or airspace restrictions. Payment for cancelled aerial services will be refunded in full.
Cancellation Policy
Last-minute cancellations or properties we are unable to access due to reasons beyond our control may incur a fee calculated at 50% of the base rate. Please provide at least 24 hours notice for cancellations to avoid this fee.
Media Usage Rights
All media is licensed for the original listing agent's marketing use only. Redistribution, resale, or use beyond the listing's marketing is prohibited without prior written permission from Aaron Wells Photography.
Media Licensing Agreement
By downloading media from Aaron Wells Photography, you agree to the following terms:
Copyright & Ownership
Unless ownership has been transferred in writing, Aaron Wells Photography retains full copyright and ownership of all media, including but not limited to photos, videos, virtual tours, and floor plans.
License Grant
Client is granted a limited, worldwide, fully-paid license to use the media for marketing the photographed property while representing the property. This license does not permit the transfer or sale of the media to others.
Modifications
The media may not be altered, edited, or manipulated in any way without the prior written consent of Aaron Wells Photography.
License Expiration
The license expires upon the sale or transfer of the property or when the client is no longer representing the property.
Additional Provisions
MLS & Third-Party Use
Media may be uploaded to Multiple Listing Services (MLS) and real estate platforms (Zillow, Realtor.com, etc.) as part of the property marketing. The license covers standard real estate marketing activities.
Social Media
Client may use media on social media platforms for property marketing purposes. Credit to Aaron Wells Photography is appreciated but not required.
Portfolio Rights
Aaron Wells Photography reserves the right to use all media for portfolio, marketing, and promotional purposes unless otherwise agreed in writing.
Liability
Aaron Wells Photography is not liable for any indirect, incidental, or consequential damages arising from the use of media services. Total liability is limited to the amount paid for services.
